Originating Processes of all civil proceedings must be accompanied by an Affidavit of Non-Multiplicity of Action – Federal High Court

The Federal High Court has restated its resolve to curb multiplicity in civil proceedings.

Consequently, Writs of Summons, Originating Summons and petitions must all be accompanied by an affidavit of non multiplicity in compliance to Order 3 Rule 3(1)(f), Order 3 Rule 9(2)(d) and Order 5 Rule 2(2)(d) of the Federal High Court (Civil Procedure) Rules 2019.

CIRCULAR

I am directed to inform you to comply with the provisions of Order 3 Rule 3(1)(f), Order 3 Rule 9(2)(d) and Order 5 Rule 2(2)(d) of the Federal High Court (Civil Procedure) Rules 2019 to the effect “that all civil proceedings commenced by either Writ of Summons, Originating Summons or Petitions, must be accompanied by an Affidavit of Non-Multiplicity of Action on the same subject matter”.
