Court Slams 5m against Police for Illegal arrest and detention
Hon. Justice Peter Affen, of the FCT High Court, yesterday, August 21, 2019, gave a judgment against the Inspector General and Commissioner General of the Nigerian Police to the sum of five million naira.
The Applicant, Mr. Bashir Mohammed in suit no: CV/2620/19 brought an action against the Nigeria Police Force, the Commissioner of Police, and the Inspector General of Police.
Mr. Mohammed accused the police of violating his fundamental human rights as enshrined by the 1999 constitution as amended.
He stated that he was arrested and detained at Nyanya police station since 29th of July, 2019 without being formally charged to court, and he was also subjected to horrendous physical torture by the policemen of Nyanya police station under the directives of their DPO.
Justice P.O. Affen ruled in favour of the applicant and ordered that Mr. Mohammed be released immediately and unconditionally. His lordship also awarded the sum of five million naira against the Inspector General of Police in favour of the applicant, Mr. Mohammed, for the gross violation of his human rights and the torture he suffered.
Human right activist, Barr. Emmanuel Okani, counsel to the applicant, praised the decision of the court for being a milestone in redressing the injustice and injury meted on the applicant. The activist further said that it will serve as a reminder, as well as a deterrent, to the police that nobody is above the law.
